How Is Property & Debt Divided in a Divorce?

Any property that has been obtained by a couple during a marriage is presumed to be community property in California. Likewise, debt incurred during the marriage is presumed to be a joint responsibility unless one party ran up significant debt on their own.

Both spouses have an equal right to community property and an equal responsibility to pay community debts. The court will balance these in determining which spouse is awarded ownership of assets and which is responsible for the debts. As our state is considered a no-fault state, circumstances such as infidelity or even domestic violence have no effect on property and debt division.

There are certain assets or property obtained during a marriage which may still be considered separate property, such as:

  • A personal inheritance
  • Any personal gifts
  • Acquisitions made during separation
