How Does a QDRO Work?

Most retirement plans require Qualified Domestic Relations Orders (QDRO) to "give direction" as to exactly how one spouse's retirement must be divided. In the property divisions of a judgment, the court may order part of one spouse's retirement or pension be divided and awarded to the other spouse. This can either be a fixed dollar amount or is based on a percent share over the lifetime of the plan. A QDRO must be precise in the order and approved by all parties including the plan administration before the court will enter it as an order.
